This Privacy Policy is designed to help you understand what information we collect at Shopby Checkout (“Shopby”) , how we use it, and what choices you have. This Privacy Policy is not intended to place any limits on what we do with data that is aggregated and/or de-identified, so it is no longer associated with an identifiable individual.

Unless otherwise defined herein, capitalised terms used herein shall have the same meaning as in Shopby Checkout Terms of Service. “Personal Data,” means any information relating to an identified or identifiable natural person.

“Shopby”, “we”, “our” or “us” means the Shopby entity responsible for the collection and use of Personal Data, under this Privacy Policy.

“ Business User” means an enterprise or individual that has a cooperation with Shopby. In general, a Business User is an online store merchant. Only when the Business User cooperates with Shopby, you can visit Shopby on its site and use our Service.

“Personal Data” means any information that relates to an identified or identifiable individual, and can include information about how you engage with our Services (e.g. device information, IP address).

1. How We Collect and Use Your Personal Data

You understand that the features of the Shopby Services may update and evolve with development of business strategies. If we will collect or use the personal information for any purposes other than those specified in this Privacy Policy, we will inform you with reasonable notice and obtain your consent before collecting or using such personal information.

Registering a Shopby Account. When you register a Shopby account, we may collect your profile data such as phone number and email address to establish an online account for you.

Using Service. When you want to conveniently complete fast checkout with merchants who are our business users (“Services”) through Shopby, we may collect or require you to provide your checkout data such as your name, recipient address, phone number, and payment method details (e.g. card number, cvc, and expiration date) to enable us to provide above Services to you.

Undertaking marketing, advertising or other promotional activities. We may collect your contact data, such as phone number and email address, for telemarketing and email marketing purposes.

Improving our Services and Risk Control. For this purpose, we will collect
(1) Your device information, such as browser type, device information, operating system, and account setting information and usage data on our site or Third-party site;
(2) Non-directly identifiable device identifiers, operating system information, cookie information;
(3) Data about how you engage with our Services, such as browsing data, IP address, plug-ins, language used, time spent on sites.

We may use your information for any other purpose disclosed to you prior to you providing us your personal information or which is reasonably necessary to provide the Services or other related products and/or services requested, with your permission or upon your direction.

2. How We Share and Transfer Your Personal Data

Affiliates. Our corporate parent, subsidiaries, and affiliates, for purposes consistent with this Privacy Policy.

  • l For the purpose of safeguarding the life, property and other major legitimate rights and interests of the Personal Data, Subject or any other person, but it is difficult to obtain the authorization and consent of that person;

  • l The personal information involved is disclosed to the public by the Personal Data, Subject;

  • l The personal information involved is collected from lawfully and publicly disclosed information;

  • l Transfer in the event of a change of operational entities following an acquisition, merger, reorganization or bankruptcy.

Note: If transfer is necessary due to the above reasons, we will inform you of the purpose and type of transfer and transferee of the information before the transfer (we will also let you know if sensitive information is involved) and obtain your consent to such transfer, except as otherwise provided by law or regulation. The transferee will continue to perform personal information related obligations hereunder. If we go bankrupt or cease operation and there is no transferee, we will delete or anonymize your personal information.

In principle, we will not disclose your personal information to the public or undefined groups, except that we may disclose your personal information based on our agreement with you or according to applicable laws and regulations.

You may have choices regarding our collection, use and disclosure of your Personal Data,:

If you no longer want to receive marketing-related emails from us, you may opt-out via the unsubscribe link included in such emails or as described here. We will try to comply with your request(s) as soon as reasonably practicable. Please note that if you opt-out of receiving marketing-related emails from us, (i) we retain the right to communicate to you regarding the services you receive (e.g. support and important legal notices) and (ii) our Business Users may still send you messages and/or direct us to send you messages on their behalf.

  • The right to request confirmation of whether Shopby processes Personal Data, relating to you, and if so, to request a copy of that Personal Data,;

  • The right to request that Shopby rectify or update your Personal Data, that is inaccurate, incomplete, or outdated;

  • The right to request that Shopby erase your Personal Data, in certain circumstances provided by law;

  • The right to request that Shopby restrict the use of your Personal Data, in certain circumstances, such as while Shopby considers another request that you have submitted (including a request that Shopby make an update to your Personal Data,);

  • The right to request that we export your Personal Data, that we hold to another company, where technically feasible;

  • l Where the processing of your Personal Data, is based on your previously given consent, you have the right to withdraw your consent at any time;

  • Where we process your information based on our legitimate interests, you may also have the right to object to the processing of your Personal Data,. Unless we have compelling legitimate grounds or where it is needed for legal reasons, we will cease processing your information when you object.

  • The right to appeal any decision by Shopby relating to these rights.

4. How We Use “Cookies” and Other Similar Tracking Technologies

A cookie is a small file stored in the Personal Data, Subject’s computer, mobile phone or any other smart terminal device by the website server when it logs into the website or browses website content, usually containing identifiers, site names and some numbers and characters. 5. Security and Retention

We make reasonable efforts to provide a level of security appropriate to the risk associated with the processing of your Personal Data,. We maintain organizational, technical and administrative measures designed to protect Personal Data, covered by this Policy against unauthorized access, destruction, loss, alteration or misuse. Unfortunately, no data transmission or storage system can be guaranteed to be 100% secure.

We retain your Personal Data, as long as we are providing the Services to you or our Business Users (as applicable) or for a period during which we reasonably anticipate providing the Services. Even after we stop providing Services directly to you or a Business User with which you are doing business, and even if you close your Shopby account or complete a transaction with a Business User, we may retain your Personal Data,:

  • to comply with our legal and regulatory obligations.

  • l to enable fraud monitoring, detection and loss prevention activities.

  • to comply with our tax, accounting, and financial reporting obligations

  • where required by our contractual commitments to our financial partners (and where data retention is mandated by the payment methods you used).

6. International Data Transfers

As we provide the Services to users in multiple jurisdictions, you acknowledge the information and data you provided to us may be transferred to, stored or processed outside of your country. In principle, we will store your personal information in Singapore. However, for statistical and analytical purposes, we may transfer your Personal Data, to regions outside of Singapore. Nonetheless, we will ensure that your personal information is adequately protected as it is in the country or region where you are located and will use encryption in cross border data transfer.

7. Updates and Notifications

We may update the terms of this Privacy Policy from time to time, and such update shall form part of this Privacy Policy. If such update results in a substantial diminution of your rights under this Privacy Policy, we will give you reasonable advance notice by posting a notice on the home page, by email or otherwise. In that case, if you do not agree with the Privacy Policy, or disagree with any updated Privacy Policy, you may stop using our Services or terminate your account. However, please note that this Privacy Policy shall still apply to you until you effectively terminate your account or cease using our Services.In the event of significant or material changes, we will notify you in a prominent manner as appropriate.
